1. Acceptance of Terms

By accessing or using Feezza (“the App”, “the Service”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and our Health Disclaimer. If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Feezza.

2. Eligibility

You must be at least 13 years of age to use Feezza. If you are between 13 and 18 years of age, you may only use the Service with the consent of a parent or legal guardian. Users in India must be at least 18 years old, or have verifiable parental consent as required under the Digital Personal Data Protection Act 2023. By creating an account, you represent and warrant that you meet these age requirements.

3. Description of Service

Feezza is a conversational AI health agent. The Service operates through a single AI conversation interface with no separate navigation tabs. Users interact with Feezza through natural language conversation to access features including food scanning, medication safety checking, health condition management, workout planning, sleep tracking, pattern detection, and doctor report generation. All features are accessible through the Feezza conversation interface. The Service is powered by Azure OpenAI (Microsoft) and other AI services.

Feezza offers two access tiers: Free (basic features with daily limits) and Premium ($19.99/month or $149/year, full feature access including voice coaching and clinical tools). Features available at each tier are described in Section 8.

The mobile application is currently available on iOS in the United States and Canada. Android availability is planned for a future date.

Autonomous Actions: Feezza may propose and execute multi-step actions on your behalf including setting reminders, adjusting notification preferences, and generating reports. All consequential actions are proposed to you before execution and require your explicit confirmation. Feezza will not execute any action that modifies your health data, settings, or account without your confirmed consent in the same conversation session. You may undo recent agent actions within the app.

Feezza — The AI Health Agent refers to Feezza’s conversational AI system that remembers your health history, acts on your goals with your confirmation, and provides personalized clinical guidance. This does not represent, imply, or substitute the services of a licensed healthcare professional. All guidance is AI-generated and intended for general informational and wellness purposes only.

4. Health & Medical Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

  • Feezza is a wellness application, NOT a medical device, medical service, or substitute for professional healthcare.

  • “Feezza” is an AI health agent powered by Azure OpenAI operated by Microsoft and other AI services, NOT a licensed health coach, nutritionist, doctor, or medical professional.

  • All nutritional information, diet plans, workout recommendations, and health insights are AI-generated estimates and may not be accurate for your specific situation.

  • Medication interaction checks are based on general medical knowledge and may not cover all interactions. Always consult your doctor or pharmacist about medication interactions.

  • Symptom tracking and follow-ups: When you report health symptoms to Feezza, these are recorded to provide personalized dietary guidance and proactive follow-up care. This constitutes nutritional guidance only — it is not medical monitoring, diagnosis, or treatment. If symptoms persist or worsen, consult a healthcare professional.

  • Doctor Reports: Reports generated by Feezza are summaries of data you have entered into the app. They are not medical records, clinical assessments, or substitutes for professional medical documentation. Feezza is not responsible for any clinical decisions made based on these reports. Always discuss health data with a qualified healthcare professional.

  • Flare Prediction: Feezza’s condition flare prediction feature identifies patterns in your personal data and may suggest potential health outcomes. These predictions are probabilistic estimates based on your historical data and are not medical diagnoses or clinical predictions. Feezza is not liable for any health outcomes resulting from reliance on or failure of flare predictions.

  • Lab Result Interpretation: Lab result interpretations provided by Feezza are for informational purposes only. They are not clinical diagnoses or medical opinions. Feezza’s interpretation is based on published reference ranges and your entered nutrition data. Always discuss lab results with your doctor or a qualified healthcare professional.

  • Do not rely on Feezza for managing serious health conditions, medical emergencies, eating disorders, or medication decisions.

  • Always consult a qualified healthcare professional before making changes to your diet, exercise routine, or medication regimen.

  • If you experience a medical emergency, contact your local emergency services immediately.

By using Feezza, you acknowledge that you have read and understood this disclaimer, and you agree to use the Service at your own risk.

5. User Accounts

  • You must provide accurate and complete information when creating an account.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You are responsible for all activities under your account.

  • You must notify us immediately of any unauthorized use of your account.

  • We reserve the right to suspend or terminate accounts that violate these Terms.

6. Consent and Data Processing

By creating an account, you consent to the collection and processing of your personal and health data as described in our Privacy Policy. This includes sending your meal data, health conditions, and profile information to AI services including Azure OpenAI operated by Microsoft for analysis, hosting your data on Replit application infrastructure, and storing your data on Neon database infrastructure in the United States. You may withdraw consent at any time by deleting your account, though this will result in loss of access to the Service.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose

  • Attempt to gain unauthorized access to any part of the Service

  • Interfere with or disrupt the Service’s functionality

  • Upload malicious files, viruses, or harmful content

  • Impersonate another person or misrepresent your identity

  • Use the Service to provide medical advice to others

  • Scrape, harvest, or extract data from the Service

  • Share your account credentials with others

8. Subscriptions and Payments

a) Plans

Feezza offers two subscription tiers. Free includes basic meal logging, 5 Feezza messages per day, and 3 food scans per day. Premium ($19.99/month or $149/year) unlocks up to 100 Feezza messages and 60 food scans per day (lower in some regions), AI body scans and progress photos, live-scan camera, Specialist Mode (deeper clinical reasoning), morning briefings, weekly review sessions, personalized meal plans and workouts, medication interaction warnings, lab interpretation, condition-specific clinical targets, doctor report PDF, flare prediction, emergency alerts, and family sharing. Premium includes a 7-day free trial for new subscribers. A legacy Plus tier exists for grandfathered subscribers only and is no longer offered to new customers.

b) Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually). For iOS users, payment is processed through your Apple ID via Apple’s in-app purchase system managed by RevenueCat. For web subscribers, payment is processed securely through Stripe. You authorize recurring charges to your payment method.

c) Cancellation

  • You may cancel your subscription at any time from your Profile settings or by contacting support.

  • Cancellation takes effect at the end of your current billing period.

  • No refunds for partial billing periods unless required by applicable law.

  • Your account reverts to the Free tier after cancellation.

d) Price Changes

We will provide at least 30 days notice before any price increase. The new price applies at your next billing cycle. You may cancel before the price change takes effect.

e) Free Trials

If offered, free trials convert to paid subscriptions unless cancelled before the trial ends. You will be notified before conversion.

9. Country-Specific Terms

India Provisions

  • DPDPA Compliance: For Indian users, Feezza processes personal data under the Digital Personal Data Protection Act 2023. You may access, correct, update, erase, or withdraw consent for your personal data.

  • Consent Manager: Where required, Feezza will support consent management and withdrawal mechanisms.

  • Grievance Officer: Indian users may contact our Grievance Officer at legal@feezza.ai.

  • Governing Law: For Indian users, these Terms are governed by applicable Indian law.

United States Provisions

  • FTC Compliance: All health-related claims and features in Feezza are clearly identified as AI-generated wellness guidance. We do not make any medical claims.

  • CCPA/CPRA Rights (California): California residents have additional rights under the California Consumer Privacy Act including the right to know, delete, and opt-out. See our Privacy Policy for details.

  • COPPA: Feezza is not directed at children under 13. We do not knowingly collect data from children under 13.

  • MHMDA (Washington): Washington residents have additional rights under the My Health My Data Act. We maintain a standalone Consumer Health Data Privacy Policy that details how we collect, use, share, and protect consumer health data.

  • HIPAA Disclaimer: Feezza is not a HIPAA-covered entity. Health information shared on the platform is not subject to HIPAA protections.

  • Apple HealthKit Compliance: If you connect Apple Health, your health data is used solely to provide personalized nutrition and fitness tracking. HealthKit data is never used for advertising, marketing, or data mining. It is never shared with ad networks or data brokers. Push notifications never contain specific health information. See our Privacy Policy for full Apple HealthKit Guidelines.

  • Data Portability: All users have the right to export their personal data in a machine-readable format. Data export is available from your Profile settings. We will provide your data within 30 days of a verified request.

  • Governing Law: For US users, these Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.

  • Arbitration: Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. California residents may opt out of binding arbitration by notifying us in writing within 30 days of account creation at legal@feezza.ai.

Canada Provisions

  • PIPEDA Compliance: Canadian users may access, correct, or challenge the accuracy of personal information held by Feezza.

  • CASL: We comply with Canada’s anti-spam legislation for marketing communications.

  • Law 25 (Quebec): Quebec residents have additional rights regarding transparency, profiling, and privacy by default.

  • Governing Law: For Canadian users, these Terms are governed by applicable Canadian federal and provincial privacy laws.

10. Intellectual Property

All content, features, and functionality of Feezza (including but not limited to the software, text, design, graphics, logos, and the “Feezza” brand) are owned by Feezza and are protected by copyright, trademark, and other intellectual property laws. Your meal data and personal content remain yours.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FEEZZA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY HEALTH DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE SERVICE; (C) UNAUTHORIZED ACCESS TO YOUR ACCOUNT; (D) ERRORS IN NUTRITIONAL INFORMATION OR AI-GENERATED ADVICE.

Emergency Alert System: Feezza’s critical health alert system is designed to notify you of potentially dangerous health readings based on published clinical thresholds. These alerts are informational only and do not constitute medical advice or emergency medical services. Feezza is not liable for any harm resulting from reliance on or failure of the emergency alert system. In any medical emergency, contact your local emergency services immediately.

12. Account Termination

You may delete your account at any time from your Profile settings. We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Data deletion follows our Privacy Policy retention schedule.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use after changes constitutes acceptance. If you disagree with any changes, you may delete your account.

15. Force Majeure

Feezza shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, internet outages, or third-party service failures including AI provider outages.
